Top Judge Halts Iran Execution
(New York City) Iran's Chief Justice has halted the execution of 21 year old man who allegedly had sex with another male when the accused was only 13 years old, an international human rights group reports.
But Mouloodzadeh's legal problems are not over.
As is usual in Iran when a male is charged with having sex with another person of the same sex the charge against Makvan Mouloodzadeh was registered as rape.
Chief Justice Ayatollah Seyed Mahmoud Hashemi Shahrudi in his ruling described the death sentence to be in violation of Islamic teachings, the religious decrees of high-ranking Shiite clerics, and the law of the land, the International Gay and Lesbian Human Rights Commission said.
It is believed to be the first time a sodomy conviction had been overturned based on Islamic teaching and followed a letter from the IGLHRC to to the Iranian authorities. Other human rights organizations, including Amnesty International, Human Rights Watch, and the Iranian Queer Organization also pleaded for Mouloodzadeh's life.
At his trial no witness ever accused Mouloodzadeh of rape. Instead, the prosecution witnesses all told the court that their statements during the investigation were either untruthful or coerced.
A review by the IGLHRC of the investigation showed it was riddled with procedural irregularities the group said in a statement.
"This is a stunning victory for human rights and a reminder of the power of global protest," said Paula Ettelbrick, IGLHRC's executive director.While the chief justice's action blocks Mouloodzadeh from being immediately executed he remains in prison.
The ruling sends the case back to the lower court for retrial. Under Islamic law sodomy is a capital crime punishable by public lashings or hanging.
Some international gay rights groups believe that more than 4,000 lesbians and gay men have been executed since the Ayatollahs seized power in 1979.
The government in Tehran has repeatedly denied the reports.Earlier this week it was learned that during a meeting between British and Iranian politicians a high ranking Iranian cabinet minister acknowledged for the first time that the Islamic state upholds the hdeath penalty for homosexuality.
The disclosure was in marked contrast to remarks in September by President Mahmoud Ahmadinejad during a speech at Columbia University when he declared there were no homosexuals in Iran. "In Iran we don't have homosexuals like you do in your country. We do not have this phenomenon. I don't know who's told you that we have it," Ahmadinejad said.

Dernière illustration de l'enracinement du politiquement correct au cœur même du discours de certains médias (voir mon bloc-notes de vendredi) : la pénalisation de la critique du "métissage", qui vient s'ajouter à la difficulté qu'il y a à critiquer certaines religions ou doctrines, et singulièrement l'idéologie islamiste dans ce qu'elle peut avoir de totalitaire.
L'accusation d'islamophobie est devenue un obstacle à l'expression de l'esprit critique.
Or voici qu'un nouvel interdit s'ajoute à la panoplie.
C'est Edwy Plenel, ancien directeur de la rédaction du Monde, qui s'est fait, dimanche, le porte-voix de cette nouvelle interdiction de penser en soutenant - lors d'une table ronde sur "Les médias face à l'antisémitisme" (1) à laquelle je participais - que s'il faut bien sûr résister à l'antisémitisme, il fallait aussi combattre le "nouveau racisme" que serait la critique du métissage.
Ce raisonnement est l'illustration de la remarque d'Alain Finkielkraut, décrivant en 2006 l'idéologie antiraciste comme "le communisme du XXI è siècle".
On peut déjà trouver suspect l'éloge du métissage, compris comme une supériorité. Mais le mot ne désigne pas, en l'occurrence, le mélange des sangs qui n'est pas un problème pour la France, dont la Constitution ne fait pas de différence entre les races. C'est la critique du métissage culturel, c'est-à-dire du multiculturalisme, que Plenel voit comme un nouveau racisme.
Il cautionne l'interdiction de critiquer ceux qui demandent à la France, démocratie ouverte, de renoncer à la centralité de son identité.
Cette instrumentalisation de l'antiracisme, qui aboutit à rendre tout débat impossible, est une insulte à la liberté d'opinion.
Concernant la vision qu'ont les médias d'Israël (sujet d'hier), cette culpabilisation est celle qui est développée par ses opposants, qui ne supportent pas de voir l'Etat hébreu défendre son histoire, sa langue, son identité en s'opposant, y compris par la force, à un djihad qui veut le rayer de la carte.
C'est au nom de l'antiracisme que la conférence mondiale contre le racisme de Durban, (2001, Afrique du sud) s'était vautrée dans l'antisionisme et l'antisémitisme. Le Duban, II, qui s'ouvrira en 2009, se prépare à renouveler la démonstration. L'idéologie antiraciste alimente l'antisémitisme.
