Wanted man uses kosher diet to avoid extradition

An Israeli judge refuses to extradite a U.S. fugitive from justice because there's no guarantee kosher food would be provided in the Florida prison system.

Lawrence Seth Wayne was sentenced to 19 years in prison in 1998 in a DUI (driving under the influence), hit-and-run manslaughter case.

After losing an appeal, he fled from Florida to Israel before he could be imprisoned.

Mat Staver of Liberty Counsel says it's "a far stretch of interpretation" on the part of the judge who refused the man's extradition.

Matt Staver"Actually what he's doing is interpreting a particular law that prohibits harm if it's harm to the public policy or critical interest to the state of Israel, in terms of extradition," says Staver. "The fact of the matter is, this does not violate any kind of critical interest to the state of Israel and certainly no public policy."

It is not even known if Wayne is an observant Jew who follows kosher diet rules.

"There's 35 states that in fact do provide prisoners with kosher food, and obviously this prisoner could be extradited anywhere in those 35 states," Staver explains. "I think this is one of those judicial activism situations that we see in the United States. Obviously, I think it's playing out with this judge in Jerusalem."

Wayne fled the country in 2000 using a forged passport and an assumed name. After a 10-year manhunt, the FBI finally located the fugitive.

He was arrested with the help of Israeli authorities.
